Privacy Policy

1. Scope

These Terms apply to all websites operated and services provided by Markus van Driel, including:

Hereafter collectively referred to as the “Site.”

2. Intellectual Property

All content on this Site, including but not limited to text, videos, graphics, photos, audio, downloadable materials, course content, logos, and branding, is protected under Dutch and European copyright and intellectual property law.

You are granted a limited, personal, non-transferable, non-commercial licence to access and view the content solely for your own use. You may not reproduce, distribute, modify, or commercially exploit any part of this Site without prior written consent.

Use of our trademarks, including “Neuro Pathway Mapping™” and "The Human Connection Code™", is strictly prohibited unless expressly authorised.

3. User Content

You agree not to:

- Use the Site for any unlawful, harmful, or fraudulent purpose

- Interfere with the functioning of the Site or attempt to gain unauthorised access to it

- Use or reuse content for commercial purposes

- Post or transmit content that is defamatory, obscene, or infringes the rights of others

We reserve the right to remove content or restrict access if we determine there has been a breach of these terms.

4. Data Protection and Privacy

We take your privacy seriously and comply with the EU General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for detailed information on how we collect, store, and use your personal data. By using this Site, you consent to the use of your personal data in line with our Privacy Policy.

5. Disclaimers

The Site and its content are provided “as is.” While we make every effort to ensure the accuracy of information, we offer no guarantees regarding:

- Accuracy, completeness, or suitability for a particular purpose

- Availability or uninterrupted use

- Results or outcomes from using our services, coaching, or content

Use of the Site is at your own risk.

6. Limitations of Liability

To the maximum extent permitted by Dutch and European law, we exclude liability for:

- Direct or indirect losses

- Loss of profits, data, or business opportunities

- Any damage resulting from viruses or technical failures

This limitation does not apply to liability for death or personal injury caused by our negligence, fraud, or other cases where liability cannot be excluded under law.

7. Third-Party Services

We may use third-party tools or platforms. You are responsible for reviewing and agreeing to their terms independently. We do not accept liability for third-party websites or services.

8. Submissions

Any content, ideas, or feedback submitted to us (e.g. testimonials, reviews, emails) may be used by us for promotional, commercial, or development purposes without compensation or obligation, unless otherwise agreed in writing.

9. Termination

We reserve the right to restrict, suspend, or terminate your access to the Site or its services if we reasonably believe you have violated these Terms or applicable law.

10. Governing Law

These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent court in Amsterdam, unless otherwise required by mandatory law.

11. Satisfaction guarantee One on One Coaching programs

11.1. Purpose and Scope

To ensure a high-quality coaching relationship, a Satisfaction Guarantee is offered on specific coaching packages. This guarantee allows the Client to discontinue the program if the Coachee determines that the coaching is not a fit, subject to the conditions below.

11.2. One-on-one coaching programs with a total duration of four (4) weeks:

Deadline:

The guarantee is valid until the scheduled start time of the second session.

Refund Amount:

If a cancellation request is made before the second session, the Client is entitled to a refund of 50% of the total package price.

Fees:

This refund is subject to a €25 administrative and processing fee, which will be deducted from the final amount.

11.3. One-on-one coaching programs with a total duration of ten (10) weeks or longer:

Deadline:

The guarantee is valid until the scheduled start time of the third session.

Refund Amount:

If a cancellation request is made after the second session but before the start of the third, a full refund will be issued. Minus a €25 administrative fee.

11.4. Forfeiture of Guarantee

The right to a refund under this Satisfaction Guarantee expires immediately upon the commencement of the second session (for 4-week programs) or the third session (for 10-week programs). No partial or full refunds will be issued for sessions already conducted or for remaining sessions after these deadlines have passed.

11.5. Procedure for Cancellation

To invoke this guarantee, the Client must notify the Coach in writing via email at [email protected] at least 24 hours prior to the start of the session that triggers the expiration of the guarantee (the 2nd or 3rd session, respectively).

11.6. Waiver of Statutory Cooling-Off Period/Herroepingsrecht)

By booking a session and requesting a start date within 14 days of purchase, the Client explicitly requests the immediate commencement of the service. The Client acknowledges that they thereby waive their statutory EU right of withdrawal (herroepingsrecht) once the service has been fully performed or initiated, and agrees that any refunds are governed solely by this Satisfaction Guarantee.

12. Satisfaction Guarantee The Boyfriend Formula

12.1 Purpose and Scope

The Boyfriend Formula (Trial & Subscription)

12.1. Trial Period

The "Boyfriend Formula" begins with a fixed-term trial (e.g., 2 weeks for €10). This period allows the Coachee to experience the program at a reduced rate.

12.2. Automatic Renewal

By signing up for the trial, the Client explicitly agrees that the trial will automatically convert into a full-priced monthly subscription at €197 per month at the end of the trial period, unless the Client cancels the subscription before the trial expires.

12.3. Cancellation & Notice

Following the trial period, the program operates as a monthly subscription. The Client may cancel at any time. In accordance with the Dutch Wet van Dam, a maximum notice period of one (1) month applies.

12.4. Reminders

As a courtesy, the Coach will send electronic reminders before the trial converts. However, the responsibility to cancel remains with the Client.

12.5. No Refund on Trial:

The €10 trial fee is non-refundable once digital access has been granted, as the service is initiated immediately at the Client's request.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Site. Continued use of the Site after changes constitutes your acceptance.
